1. The agreement
These terms are an agreement between you and [COMPANY NAME] (“we”) about using the ETA app for Android, its optional backup service and this website. By installing or using ETA you accept them. If you don’t, please don’t use ETA.
Our privacy policy explains what ETA records and where it goes. It’s part of these terms.
2. What ETA is
ETA is a personal trip journal. It records the location of trips you start and end, and shows reports, totals and estimates based on them. ETA isn’t a navigation app: it doesn’t give directions, predict arrival times or know speed limits.
3. Use ETA safely
Use ETA only where it’s safe and legal to handle your phone. If you’re driving, start the trip before you set off and end it once you’ve stopped. Keep your attention on the road and follow traffic laws. The speed ETA shows is not a substitute for your vehicle’s speedometer.
4. Estimates
Distances, speeds, times, addresses and costs come from your phone’s GPS, Android’s geocoder and the figures you enter. They can be incomplete or wrong, for example when GPS is weak. Check them before relying on them for anything that matters, such as expense claims, tax records or disputes.
5. Who can use ETA
You must be at least 18, or the age of majority where you live if that’s higher.
6. Your backup account
ETA works without an account. Backup needs one, opened with your email address and a one-time code. Keep access to that email, because it’s how you sign in. You’re responsible for what happens under your account. You can delete it at any time in Settings › Account.
7. Your data
Your trips, routes, notes, vehicles and fill-ups stay yours. If you turn on backup, you let us store and copy them only to back them up and restore them for you. We don’t claim ownership of them and don’t use them for anything else.
8. Fair use
Please don’t:
- use ETA to record another person’s location without their knowledge and consent;
- try to reach other people’s data, or get around ETA’s security;
- overload, disrupt or abuse the backup service;
- copy, modify or reverse engineer ETA, except where the law allows it.
9. Other services
ETA relies on Google services (Google Play, Android’s geocoder and Google Maps) and, for backup, on Supabase and Cloudflare. Their own terms and policies apply to their services, and we’re not responsible for them.
10. Price
[State whether ETA and its backup are free, or describe any paid features, how they’re billed through Google Play, and how refunds work.]
11. Changes to ETA
We may change, pause or stop ETA or its backup service. If we plan to stop backup, we’ll give you at least [NOTICE PERIOD] notice so you can export your trips. Trips on your phone aren’t affected.
12. No warranty
ETA is provided “as is” and “as available”. As far as the law allows, we make no promises that it will be error-free, uninterrupted or fit for a particular purpose. Nothing in these terms limits rights you have under consumer law that can’t be limited.
13. Liability
As far as the law allows, we aren’t liable for indirect or consequential losses, for lost data, or for losses that come from relying on ETA’s estimates. Our total liability to you for any claim is limited to [AMOUNT].
14. Ending
You can stop using ETA at any time and delete your account. We may suspend or close an account that breaks these terms, and we’ll tell you by email where we can.
15. Changes to these terms
We’ll post any changes here and update the date at the top. [Say how you’ll tell people about significant changes, for example in the app or by email.] If you keep using ETA after a change takes effect, the new terms apply.
16. Governing law
These terms are governed by the laws of [JURISDICTION]. Disputes go to the courts of [JURISDICTION], unless the law where you live gives you the right to bring them there.
